North Carolina Separation Agreement

If you are looking for information about filing for legal separation or having separation papers drawn up, you have come to the right place. In North Carolina, legal separation does not require any written document, but a Separation Agreement and Property Settlement (also known as a Marital Settlement Agreement) is highly recommended.

A Separation Agreement and Property Settlement resolves issues such as alimony, child support, child custody and visitation if you have children, and property division. The Separation Agreement also establishes the date of legal separation and allows both spouses to conduct their lives and business as though you were no longer married.

Once you have entered into a Separation Agreement and Property Settlement, your divorce becomes an “uncontested” divorce. This service allows you to get inexpensive North Carolina legal separation papers online, without having to visit an attorney’s office. Separation papers do not have to be filed, but they do have to be signed and notarized by each party.

This online service is a good fit for you if either:

  1. you and your spouse have worked out or are in the process of working out all of the above issues between yourselves and do not need to attend mediation or have your rights settled in court,
    or
  2. you and your spouse have no marital property, no children, and neither spouse is seeking alimony.

The $1000 fixed fee includes the drafting of your agreement, instructions for executing the agreement, and up to four hours of attorney time. For clients who have already settled all issues with their spouses, four hours is ample time to complete the agreement. A $100 per hour additional fee applies to cases in which more extensive assistance is required. Ideally, you should enter into a Separation Agreement as soon as you separate in order to protect your rights. However, you may enter into a Separation Agreement at any time between the days leading up to separating up until the date your divorce decree is entered by the court. North Carolina Parenting Plan – $500

A detailed parenting plan can make it much easier for a separated or divorced couple to share time with the children and to avoid conflict. Use a parenting plan to establish the usual custody and/or visitation schedule as well as to plan for special events, holidays, and birthdays. Our separation agreements include a parenting plan, so you only need to purchase a separate parenting plan if you are not purchasing a separation agreement.

This online service may be for you if:

  1. you already have a separation agreement that does not cover your custody or parenting arrangement,
    or
  2. you and your spouse have not yet worked out other issues related to your separation and divorce, but you want to establish a parenting plan immediately rather than waiting for the remaining issues to be resolved.
